The legislative developments affecting the electricity sector in 2009 changed the procedure for representation and premium payments, incentives and supplements to electricity generation facilities under the special arrangement, which is now referred to as Electricity production from renewable energy sources, cogeneration and waste.
In application thereof, as of November 2009 Curenergía Comercializador de Último Recurso, S.A.U. is the representative before the CNMC and the market and system operators (respectively OMEL & REE) for all facilities that have not expressed their wish to be represented by another agent.

The Online Office for Auto-producers or Producers of electricity from renewable energy sources, cogeneration and waste is an CURENERGÍA application for holders of electricity production facilities running on renewably energy sources, cogeneration and waste who are represented or have been represented by CURENERGÍA as their last resort representative (RUR) for this activity.
Through the Online Auto-producers Office, represented holders can manage regular operations and enquiries on production data and records of their plants and facilities, as detailed below:
- Send and look up production forecasts/programmes (facilities with P. Power ? 1 MW).
- Look up the facility's structural data and mailing address.
- Draft Annexe IV with the contribution of the facility's annual data.
- Look up help documents and current legislation.
- Look up a summary of measurements and, where applicable, the load curves for each payment period before each payment.
- Look up billing from the CNMC publication date (since activity start and/or as of November 2009).
- Look up and access valid data for the representation period.

Circular 4/2009 establishes the new economic payment model for producers of electricity from renewable energy sources, cogeneration and waste, and the implementation of the procedures to be applied by the involved agents.
The new payment system came into force on 1 November 2009. Since then, payment is processed by the CNMC (erstwhile CNE) and settled by each facility's representatives.
The economic conditions and procedure of this activity was updated by Royal Decree 413/2014 of 6 June.
The following agents are involved in the payment process:
- Representing agent
- Distribution company
- REE (System Operator)
- OMEL (Market Operator)
- CNMC (National Markets and Competition Commission)
Representatives act on behalf of a market actor, either in its name (direct representation) or under their own name (indirect representation).
On the daily and intraday electricity production market, along with the common representation, there is a specially qualified representing agent solely for representing facilities that produce electricity from renewable energy sources, cogeneration and waste. This qualified representative is referred to as the selling agent and, in addition to its ordinary functions of representation, has the powers provided for by article 28 of Royal Decree 436/2004 of 12 March.
The representative, which must be an authorised market agent, brings the energy produced at the facilities to the market, integrates the production forecasts of these facilities and manages their payment on OMEL's daily market.
The representative also sends the "Baldita" information received from the System Operator to the CNMC before the tenth day of month m+1. This information is broken down for each facility or CIL (Production Facility Code for Payment Purposes) for production months m, m-3 and m-11.
This agent is also responsible for paying the amounts received from the REE and CNMC to the represented energy producers, incorporating, where appropriate, any deduction for deviations.
As the agent responsible for reading type 3 and type 5 meters, the distribution company triggers the process and must send the hourly measurement (real or estimated) of the net active and reactive energy per facility ("CIL" code) before the eighth day of month m+1. The CNE calculates the Equivalent Premium and Reactive Allowance based on this information.
In addition to reading type 1 and type 2 equipment, this agent sends the "Baldita" for energy production months m, m-3 and m-11, broken down by representative agent, to the representative and the CNE (Spanish National Energy Commission), before the eighth day of month m+1.
This agent matches the production offers received from the representatives on the daily market.
The CNE calculates the equivalent premium and the reactive energy supplement of Special System facilities based on the data provided by the agents involved in the payment process.
It is also responsible for the actual payment to representatives of premiums, bonuses and supplements.
Payment closure for energy produced in month "m" is done on the twenty-eighth day of month "m+1", though there is a series of variable deadlines to approve and validate payments, which will most likely be settled within second ten day's of month "m+2" (between the 10th and 20th). Notwithstanding the foregoing, should the aforementioned payment date be delayed, the payment deadline would be no later than thirty-one calendar days from the close of month "m", which is done in month "m+1" in accordance with the commitment undertaken by the CNMC (erstwhile CNE) through Circular 4/2009.
This payment settled in the month (m+1) will correspond to the previous month's production (m). They are referred to as provisional payments because not all the facilities have equipment with real reading systems and, in such cases, payment is made on the basis of estimates and must be reviewed (in payments after the month in question).
The CNMC makes a second payment, the Intermediate Provisional Payment (m+3), three months after the production period (m), and the First Final Provisional Payment (m+11) eleven months after the production period (m).
Successive payments may vary the amount of income paid in the provisional payments depending on the real production variation compared to the estimate made in each one.
