General terms and conditions of the e-billing service
These General Terms and Conditions regulate the contractual relations between Cuernergia, with registered address in Bilbao, Plaza Euskadi, 5, and the clients who are users of the My Customer Area (MCA) and sign up for Cuernergia's MCA E-Billing service. The user's completion of all the steps for registering for this electronic billing service implies their express, full and unreserved acceptance of all these General Terms and Conditions for registering with the Curenergia's MCA E-Billing service that Curenergia will publish on the website www.curenergia.es.
ONE. PURPOSE
The purpose of these General Terms and Conditions is to provide the Curenergia MCA E-Billing service to customers who are users of the Curenergia MCA. Registration with this service will imply that, as from the date on which the registration takes effect, the customer shall no longer receive his bill on paper by post, as laid down in the following terms and conditions.
TWO. SERVICE FEATURES
2.1. Registration with the Cuernergia MCA E-Billing service shall be voluntary and free of charge for the customer. Customers may cancel their request at any time and return to the ordinary paper billing system by notifying Cuernergia through the MCA.
2.2. The bills issued by Curenergia for the various services provided shall be uploaded to the MCA on the website www.curenergia.es in optical format (PDF). Therefore, customers may view the bills over the Internet in the same format as the format of the bills sent on paper.
2.3. The customers registering for this service shall no longer receive the ordinary printed bill, but they shall have the option of requesting a duplicate copy of the bill on paper at any time, either through the MCA on the website www.curenergia.es or through the usual commercial channels Curenergia provides for its customers (customer telephone: 900 225 235). The said duplicate copy shall be sent by ordinary post.
2.4. In addition to displaying on-screen the image of the bill and the details, this service enables you to download this information to your personal computer. The electronic bill obtained in this manner is based on the use of an electronic signature system to guarantee the authenticity of its origin and the integrity of its content under the terms and conditions laid down in ORDER EHA/962/2007 (Official State Gazette of 14 April 2007). In this regard, we remind you that additional provision One of this Order establishes that “In order to facilitate the administrative verifications in relation to the documents regulated by this Order, during the period set out in tax regulations, the user must keep the data on a computer medium readable and processable by computer systems other than those used to create the data.”.Curenergia has obtained a 2CA-class (x.509.v3) electronic certificate from the FNMT, which enables it to incorporate an advanced electronic signature in its bills.
2.5. The Curenergia MCA E-Billing service will be implemented through a system for sending messages by e-mail which will notify the registered customers that the bills for the various services they have contracted are available for consultation at the Curenergia MCA on ;www.curenergia.es.
2.6. The service users shall be responsible under all circumstances for notifying Curenergia of any change to the e-mail address at which they wish to receive the notices. The fact that the users do not receive this notice as a result of either an error in the e-mail address provided to Curenergia or any other reason shall not imply the cessation of the Curenergia MCA E-Billing service once the users have registered with the service and have not subsequently cancelled their request.
THREE. REGISTRATION WITH THE SERVICE
3.1. Registration with this service shall be through the Curenergia MCA (www.curenergia.es), where, once the users have authenticated with their username and password, the E-Billing service may be contracted as per these General Terms and Conditions.
3.2. When the user has several contracts or has contracted various services provided by Curenergia that generate various bills, registration with the E-Billing service shall apply to all the contracts selected by the customer on the MCA and subject to the same tax ID number. This registration shall only affect the part of the bill issued and sent to the customer on paper.
FOUR. COMING INTO EFFECT
4.1. The users shall be understood to have given their consent to registration with the Curenergia MCA E-Billing service from the moment when they send their acceptance using the form available on this website correctly completed. From that moment, the user accepts and abides by all the General Terms and Conditions laid down in this text.
FIVE. CURENERGIA UNDERTAKINGS
5.1. Curenergia assumes the following undertakings with regard to the relationship established with the customer registering with the Curenergia MCA E-Billing service.
5.1.a). Through the MCA, Curenergia will implement a system for sending e-mails to the addresses provided by the users registered with the service.
The message received by the users of this service shall inform them that their bill, with the corresponding details, is available for viewing on the Curenergia MCA (www.curenergia.es) and, where applicable, may be printed at home.
5.1.b). Should the computer systems detect that the e-mail has not been received correctly, the e-mail will be resent. In any case, the possibility of consulting the electronic bill on the Curenergia MCA on the website ;www.curenergia.es ;is not subject to the sending and reception of the notice message, which is for information purposes only, and the customers are responsible for duly updating their e-mail address.
5.2. Curenergia hereby guarantees the security and confidentiality of this query since:
5.2.a). The notice message sent by e-mail will not contain any information regarding the bill other than the date of issue and the reference number that identifies the contract.
5.2.b). When the customers access the query on the Curenergia MCA on the website ;www.curenergia.es, they will be asked to validate their username and password, which will be unique for each customer and sent to users by confidential means.
5.2.c). Furthermore, the customers will be able to change their password at any time using the function provided by the Curenergia MCA.
SIX. CUSTOMER UNDERTAKINGS
6.1. The customers assume the following undertakings when they register with the Curenergia MCA E-Billing service:
6.1.a). To correctly, truthfully and accurately complete the application forms and the corresponding fields according to the instructions specified by the Curenergia MCA (www.curenergia.es).
6.1.b). To report any changes to the e-mail address given for notification purposes using the procedures laid down by the Curenergia MCA (www.curenergia.es).
6.1.c). To complete all the fields on the form unless indicated otherwise. Otherwise,Curenergia cannot guarantee the provision of all the services it provides through the Curenergia MCA, in particular the undertaking to send notices to the e-mail address if this address is not provided correctly.
SEVEN. RESPONSIBILITIES
7.1. The customer hereby guarantees and assumes responsibility under all circumstances for the accuracy, truthfulness and authenticity of the personal details provided on the Curenergia MCA application forms.
EIGHT. DATA PROTECTION
8.1. Pursuant to the Personal Data Protection Act 15/1999, the customer is hereby informed of and provides his/her consent to the processing of his/her personal data provided as a result of the contract for this service in accordance with the terms and conditions laid down in the Privacy Policy section.
